Pension and Benefits Reforms Should Apply to the Judiciary

Senator Gerald Cardinale, the senior Republican member of the Senate Judiciary Committee, issued the following statement regarding the refusal of prospective judges to state that they believe that recently enacted, bipartisan pension reforms apply equally to all public employees.

“I support Governor Christie’s argument that the pension reforms apply equally to all public employees, including the Judiciary. I am disturbed that three of the judges renominated for tenure did not express solidarity with the other employees of the State of New Jersey.

Senator Gerald Cardinale, a member of the Senate Judiciary Committee, issued the following statement supporting Governor Christie’s call for a constitutional amendment to clarify that the Judiciary must pay more for their pension and health benefits:

“I support the Governor’s call for an amendment to address the recent court decision that found that the Judiciary is exempt from the higher contribution requirements in the recently passed pension and health benefits reforms.     This is fundamentally an issue of fairness, all public employees are making sacrifices, and judges should not be set apart as a special, privileged class of employee  – the Judiciary.

Senator Gerald Cardinale noted today that two of the five voting members of the New Jersey Supreme Court dissented from the latest Abbott Decision because the “relief demanded of this court treads on the constitutional prerogatives of the Legislature and the Executive branch.” Cardinale stated:

“The two dissenting opinions of the court are very telling. Two justices argued that the court had no right to order the Legislature to spend money. This is a principle that is maintained in both the state and federal constitutions. Only the Legislature can appropriate and spend the taxpayers’ money, not the executive branch and certainly not the Supreme Court.

Bill Would Give Incentives to Entrepreneurs to Create Jobs, Stop Revenue Loss to Other States

Senators Joe Kyrillos (R-13) and Gerald Cardinale (R-39) introduced legislation earlier this month that would make New Jersey more competitive for small businesses and hospitable to retirees.

The bill, S-2778, would increase the filing limit for the estate tax to $1 million. Currently, returns for the estate tax must be filed if the estate is in excess of $675,000.

Exempts Donated Money From State Taxes

Legislation sponsored by Senator Gerald Cardinale (R-Bergen) that would exempt families, who are victims of school violence, from paying state taxes on money received from a memorial fund or other charitable cause was unanimously passed by the Senate yesterday.

“This money was raised by individuals and given to families to assist them in their time of need, ” Cardinale said. “The state should not turn around and add to their hardship by taxing these funds.”
